Litigation Support

A litigation team can benefit from the services of accounting, finance and valuation professionals such as ours. As CPAs we understand the subtleties of financial issues the way an attorney understands nuances in the law. And because our firm specializes in serving the legal profession, we can provide specialized technical resources that support an attorney's efforts throughout all phases of the litigation process.

We can provide either consulting services or expert witness services, depending on the specific needs of the attorney and client and the nature of the case.

When serving as a consultant, we are free to act as an advocate for the attorney and client and to work actively toward a winning solution for their side. As an advocate, we can pursue options that will provide the best results for the client and help determine a strategy for achieving those results. We can also provide a preliminary evaluation of the case, which can be indispensable in the determination of whether a meritorious case exists.

When serving an expert witness, we are engaged to prepare an independent opinion of the issues at hand, with the primary objective of providing assistance to the judge and/or jury in understanding the evidence or in determining the facts at issue.

We provide litigation support services in a variety of matters, and our involvement can vary depending on the nature of the case. Following are some examples of the types of cases in which we are involved and services we can provide for each.

  • In personal injury, wrongful termination and wrongful death cases, a calculation of lost wages, benefits, and household services, as appropriate, is needed to assist in settlement negotiations and/or assist a jury in determining appropriate damage awards.
  • For lost profits claims arising from breach of contract, business interruption or business destruction, an evaluation of lost sales, production costs, overhead and other expenses is necessary in determining damages resulting from the alleged wrongful act.
  • In bankruptcy and reorganization, a client may need computations of earnings and profits, assessment of the feasibility of a plan of reorganization or valuation of business assets.
  • In marital dissolution, valuation and tax strategies for the parties involved in a divorce frequently help in determining acceptable settlements.
  • In partner disputes and dissenting shareholder actions, similar to marital dissolution, valuation expertise can assist in settlement negotiations and/or be necessary for expert witness testimony at trial.
  • In any of the above situations, such as bankruptcy or partner disputes, we can act as receiver, overseeing property or business operations either by agreement of the parties to the dispute or as a court-appointed receiver.
